2. Applicability

  1. These terms and conditions apply to all offers, agreements, and deliveries by NotAGallery.
  2. Deviations are only valid if agreed upon in writing.
  3. By placing an order or confirming a purchase in writing, the buyer agrees to these terms and conditions.
  4. In case of conflict between these terms and other information on the website, these terms prevail.

3. Offer and Formation of Agreement

  1. All offered artworks are unique, unless explicitly stated otherwise.
  2. Apparent errors or mistakes in the offer do not bind NotAGallery.
  3. An agreement is concluded when the order is confirmed in writing (e.g., by email).

4. Prices and Payment

  1. All listed prices include VAT, unless stated otherwise.
  2. Shipping costs are communicated separately and agreed upon in advance.
  3. Full payment must be made within 3 days of order confirmation, unless otherwise agreed in writing.
  4. If payment is not received within this period, NotAGallery reserves the right to cancel the agreement without further notice.
  5. Shipping of the artwork takes place only after the full purchase amount, including agreed shipping costs, has been received by NotAGallery. Until then, the artwork remains the property of NotAGallery.

5. Delivery and Risk

  1. Delivery takes place at the address provided by the buyer or via collection in Nieuw-Vennep.
  2. The risk of loss or damage during shipping lies with NotAGallery until delivery to the consumer.
  3. If delivery is delayed, the buyer will be informed as soon as possible.

6. Right of Withdrawal (Consumers)

  1. The buyer has the right to cancel the agreement within 14 days of receipt without giving any reason.
  2. The buyer must notify the return within this period in writing via info@notagallery.nl.
  3. The costs and risk of returning the artwork are borne by the buyer.
  4. After receipt and inspection of the artwork, the full purchase price, including standard shipping costs, will be refunded within 5 working days.
  5. Any additional shipping costs (e.g., for express or custom shipments) and return costs will not be reimbursed.
  6. If there is damage or depreciation beyond what is necessary to assess the work, a reasonable reduction may be applied to the refundable amount.

7. Exclusion of Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made artworks;
  • Works specially modified at the buyer’s request;
  • Works specially framed or altered at the buyer’s request;
  • Artworks purchased specifically at the buyer’s request and not part of NotAGallery’s regular collection.

8. Liability

  1. NotAGallery is not liable for indirect damages, consequential damages, or lost profits.
  2. Liability is in all cases limited to the amount of the respective purchase.
  3. After delivery, the buyer is responsible for correct handling, hanging, and maintenance of the artwork.

9. Complaints

  1. Complaints regarding transport damage or visible defects must be reported in writing within 48 hours of receipt via info@notagallery.nl, including clear photos.
  2. Other complaints must be reported in writing within a reasonable period after discovery.
  3. NotAGallery will respond substantively within 14 days.

10. Force Majeure

In the event of force majeure, including but not limited to transport problems, illness, extreme weather conditions, or other unforeseen circumstances, NotAGallery is not obliged to fulfill its obligations as long as the force majeure situation continues.

11. Applicable Law and Disputes

  1. All agreements are exclusively governed by Dutch law.
  2. Disputes will be submitted to the competent court in the Netherlands.
